CONFISCATION

If you are convicted of certain crimes, including Theft, Fraud, Supply of Drugs and Money Laundering, in addition to your penalty for the crime the Court can make a Confiscation order. This seizes assets. The provisions are draconian, sometimes unfair and can lead a defendant to serve additional time in prison if not paid.

We have considerable experience dealing with Confiscation applications in the Crown Court, including cases with an International Dimension and cases alleging hidden assets.

CASH SEIZURE & FREEZING ORDERS

The Proceeds of Crime Act can give the authorities to seize cash and apply for forfeiture of it. Where the Police have grounds to believe that the cash comes from a criminal act then they can seize it. They can then apply for a Court order retaining it until the conclusion of proceedings.

The Police can also apply to a Court to freeze a bank account and other assets. Such applications are often made without the subject knowing to retain the element of surprise and then notification is given. We have expertise challenging such applications where that is appropriate.
